LensForest respects the intellectual property rights of artists, photographers, and copyright owners. We comply with the provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512) and expeditiously process formal notifications of claimed copyright infringement.

Notice and Takedown Commitment

If you believe that any image hosted on LensForest infringes upon a copyright that you own or control, you may submit a formal takedown notice to our designated agent. Upon receipt of a legally complete notification, LensForest will promptly remove or disable access to the infringing material.

1. How to Submit a Notice of Claimed Infringement

To be effective under 17 U.S.C. § 512(c)(3), your notification of claimed infringement must be written and include substantially the following information:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest that is allegedly infringed.
  2. Identification of the Copyrighted Work: Clear identification of the copyrighted photograph, artwork, or creative material claimed to have been infringed, including registration details or proof of original authorship where available.
  3. Identification of the Infringing Material: Clear identification of the specific material on LensForest that you claim is infringing, including the specific URL(s) or image slug(s) to enable us to locate and remove the file.
  4. Contact Information: Information reasonably sufficient to permit us to contact you, including your full legal name, physical mailing address, telephone number, and email address.
  5. Good-Faith Statement: A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy & Penalty of Perjury Declaration: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.

3. Takedown Procedure and Counter-Notification

Upon receipt of a valid, compliant DMCA notification, LensForest will expeditiously remove or disable access to the identified content.

If a contributor believes that their material was removed or disabled by mistake or misidentification, they may submit a written counter-notification pursuant to 17 U.S.C. § 512(g)(3) containing:

  • A physical or electronic signature of the provider;
  • Identification of the material that has been removed and the location where it previously appeared;
  • A statement under penalty of perjury that the provider has a good-faith belief that the material was removed as a result of mistake or misidentification; and
  • The provider’s name, address, telephone number, and consent to federal court jurisdiction.

4. Repeat Infringer Policy

In accordance with the DMCA and applicable copyright statutes, LensForest maintains a strict policy of terminating access for any contributor or administrator who repeatedly infringes the intellectual property rights of others.

5. Caution Regarding Misleading Claims

Section 512(f) Statutory Liability

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to substantial liability, including monetary damages, court costs, and attorneys’ fees incurred by the alleged infringer or by LensForest.
